ADOPTION INFORMATION:
WHO MAY ADOPT A CHILD IN THE STATE OF OHIO?
1. A husband and wife
2. A step-parent
3. An unmarried adult
IS A HOME STUDY REQUIRED FOR AN ADOPTION?
A home study is required in an adoption and will be conducted by an adoption agency or a Probate Court Assessor who is trained to complete the home study.
WHAT ARE THE DIFFERENT TYPES OF ADOPTIONS?
1. Step-parent Adoption: The person seeking to adopt is a step-parent of the person to be adopted. The parent whose parental rights are being terminated must consent to the adoption unless consent is not required by law.
2. Agency Adoption: The parties utilize the services of a licensed adoption agency.
3. Private Adoption: The parties use a private attorney who facilitates the adoption and serves as an intermediary between the adopting parents and the birth parents.
4. Interstate Adoption: An interstate adoption occurs when a child is born in one state and the adopting party is a resident of another state.
5. Foreign Adoption: An adoption where a child is born in a foreign country and is adopted by a party in Ohio.
WHAT IS A CLOSED ADOPTION?
In a closed adoption the identities of the parties (i.e. biological parents and adopting parent(s)) remain confidential.
WHAT IS AN OPEN ADOPTION?
In an open adoption the parties disclose some identifying information to each other. The parties may simply exchange names or the parties may go so far as to exchange contact information’ and engage in visitation.
IS A COURT APPEARANCE REQUIRED IN AN ADOPTION MATTER?
The adopting parent(s) and the child must appear at the hearing in the Probate Court unless otherwise ordered by the Court.
IS THE ORIGINAL BIRTH CERTIFICATE CHANGED AFTER AN ADOPTION TAKES PLACE?
The original birth certificate will be sealed and a new birth certificate will be issued.
