Juvenile Custody

Juvenile Custody

Vidovich Law represents clients in juvenile custody matters in Franklin County and the surrounding areas. We understand that custody matters involving children are emotionally challenging and strive to provide compassionate, thorough representation.

Types of Custody

Legal Custody – The right to make important decisions about a child’s upbringing, including education, healthcare, and religious training.

Physical Custody – Where the child primarily resides. Can be:

  • Sole custody with one parent
  • Shared parenting between both parents

Factors Courts Consider

Ohio courts make custody decisions based on the best interests of the child, considering:

  • The wishes of the child’s parents
  • The child’s wishes (if appropriate age)
  • The child’s interaction with parents, siblings, and others
  • The child’s adjustment to home, school, and community
  • The mental and physical health of all parties
  • The parent more likely to honor and facilitate visitation
  • Whether either parent has failed to make child support payments
  • Any history of abuse or neglect

Establishing Paternity

For unmarried parents, establishing paternity is essential for custody rights. This can be done through:

  • Signing an Acknowledgment of Paternity Affidavit
  • Court-ordered genetic testing
  • Administrative determination through Child Support Enforcement Agency

Modification of Custody

Custody orders can be modified if there has been a substantial change in circumstances. Contact Vidovich Law to discuss your options.
